1) Acceptance of Terms

By accessing or using TuneGate (“Service”), you agree to these Terms. If you do not agree, do not use the Service.

2) About TuneGate

TuneGate is provided by Soothing Soundwave (“we”, “us”, “our”). The Service allows users to listen to playlists and submit Spotify tracks for consideration. Playback may rely on Spotify’s official players and SDKs, subject to Spotify’s terms.

3) Eligibility & Accounts

You must be at least 16 years old. You may need a Spotify account to enable playback features. You are responsible for your Spotify account and compliance with Spotify’s Terms and Privacy Policy.

4) Submissions

• You may submit Spotify track links to be considered for playlists.
• We reserve the right to accept or decline any submission at our sole discretion.
• Do not submit content you do not have the right to share.

5) Listening Requirement

We may require you to listen for a specified duration (e.g., 30 minutes) before unlocking submission. For Premium users, in‑app playback may be available. For Free users, listening may occur in the official Spotify app or web player. Ads or platform rules may affect playback. We only count qualified playback time according to the mode used.

6) Acceptable Use

• No unlawful, abusive, or fraudulent activity.
• No attempts to bypass rate limits, captcha, timers, or technical restrictions.
• No reverse engineering, scraping audio, or infringing Spotify or third‑party rights.

7) Third‑Party Services

The Service integrates with third parties such as Spotify (playback) and hCaptcha (bot protection). Your use of those services is governed by their separate terms and privacy policies. We are not responsible for their availability or actions.

8) Intellectual Property

We retain all rights in the Service. Spotify content and trademarks are owned by Spotify or its licensors. You may not use our or their marks without permission.

9) Disclaimers

The Service is provided “AS IS” and “AS AVAILABLE”. We disclaim all warranties to the fullest extent permitted by law, including fitness for a particular purpose and non‑infringement. Playback, availability, or counting of time may be affected by third‑party services, network conditions, or device constraints.

10) Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising from or related to your use of the Service.

11) Indemnity

You agree to indemnify and hold us harmless from claims, damages, or costs arising from your use of the Service, your submissions, or your violation of these Terms or applicable law.

12) Suspension & Termination

We may suspend or terminate access to the Service at any time, including for violations of these Terms, suspected abuse, or legal/regulatory reasons.

13) Changes

We may update these Terms from time to time. The “Last updated” date indicates the latest version. Material changes will be posted within the app or site.

14) Governing Law

These Terms are governed by the laws applicable to Soothing Soundwave’s place of establishment, without regard to conflict of laws rules. Courts at that location shall have exclusive jurisdiction, unless mandatory consumer law states otherwise.
